Contacting through the phone
This might be the most common and the most quickest way of contacting the customers. This is a legal way of contacting customers which the debt collectors might adopt in order to collect the credit card debt. According to the Fair Debt Collection Practices Act, the debt collector is only allowed to call from 8am till 9pm. During the phone call, the person representing the company is not allowed to harass you through offensive language, racial or ethnic slurs or by raising fingers at your character. Furthermore, they cannot call you again and again repeatedly which would also come under harassment.
The debt collector is also allowed to threaten you with a lawsuit during the call which is allowed under the FDCPA. However, the disadvantage for them is that they have to make you aware of all their intentions and plans of what they wish to do in the future to collect the debt. They cannot threaten you until and unless they have filed a lawsuit as threatening you without filing it is illegal. If the debtor has gone missing, then the debt collector is allowed to call their relatives and any other people on their records to check for their whereabouts. However, they cannot ask their relatives to pay on behalf of their customer.
Besides using the phone, a debt collector could contact you through letters. Under the law, the debt collector is to provide you with a letter within the five days of the first phone call. That letter should contain all the information of how much money is owed, the name of the debtor and all their details. It often becomes annoying when every week you receive such letters reminding you to pay off your debts otherwise legal action could taken against you. Therefore, it’s important that you keep all these letters with you till the debt is cleared.
Involving the Court
If other techniques do not work, then the debt collector could go to the court after several attempts before going to the court. For this you would most likely receive a summon which would confirm you about the details. The court could put a certain percentage on your wage which would be paid each month towards the debt or the court could lock your bank account till all the debt is cleared.
